Common questions before you file

This service is for non-U.S. founders with no U.S. trade or business — not every LLC on OtoCo qualifies.

I invoice U.S. clients. Is that U.S.-source income?

Not automatically. U.S. source rules for services generally look at where the work is performed, not where the client is located. If you perform services entirely outside the U.S. for U.S. clients, income is usually foreign-source for U.S. tax purposes.

I have a U.S. LLC. Does that mean U.S. business activity?

No. Forming a U.S. LLC, getting an EIN, or opening a U.S. bank account does not by itself create U.S. trade or business. What matters is where work is performed and whether you have U.S. offices or employees.

When does this service NOT apply?

Not if you or another owner is a U.S. citizen or resident, the LLC has U.S. employees or a U.S. office, the LLC has U.S.-source income, or the LLC is engaged in a U.S. trade or business (ETBUS). Contact OtoCo for complex cases.
